JD.HK Open Platform Store Termination Rules
Chapter I Termination of Cooperation
Natural termination: The store service period expires and the merchant has not completed the renewal;
Early termination: If the store is closed before the service end date, please refer to the following "Appendix 1: Early Termination Operation Steps" for the operation steps for terminating the agreement.
Chapter II After the termination of cooperation, how to refund the deposit and platform servicve fee
2.1 Platform service fee:
According to the contract, early termination will not be refunded.
2.2 Margin:
2.2.1 After the termination of the service agreement and the termination of all orders of the specific store stipulated in the service agreement, all disputes and claims have been processed, and the warranty period of the completed transaction has expired, the merchant can initiate a deposit refund application in the background. If the account is frozen due to administrative investigation and other reasons, the deposit will be refunded to the bank account maintained and verified at the merchant backstage after the online application for deposit refund is completed (including conditions such as store closure for 3 months and completion of settlement) . Products with a product warranty period of more than 3 months must also meet the conditions for the expiration of the warranty period of all sellers at the same time.
2.2.2 If a merchant is cleared by JD.HK Open Platform for selling counterfeit goods or other violations, the margin will be fully deducted in accordance with the rules and regulations. For details, please refer to the JD.HK Open Platform Margin Management Regulations.
Chapter III Other Explanations
3.1 According to the requirements of the E-Commerce Law, third-party merchants on e-commerce platforms need to explain to consumers about the closure of stores 30 days in advance before exiting the platform. After the investment promotion staff has reviewed your withdrawal application, it will enter the publicity period. Please wait patiently.
3.2 Commodities sold during the publicity period will normally be included in the warranty period for the refund of the deposit after the merchant closes the store. In order to complete the deposit refund process as soon as possible, it is recommended that you remove the goods from the shelves in a timely manner after the return is approved.
3.3 If your store signs a non-electronic agreement when entering or renewing, your electronic termination agreement may fail to sign. Please contact your investment promotion or wait for the reviewer to contact you to complete the signing of the offline termination agreement.
3.4 After the store is closed, you need to actively apply for a refund of the deposit. You can contact JDmarketplace@jd.com or worldwide@jd.com.
Chapter IV Supplementary Provisions
4.1 Any conduct of the merchant of JD.HK Open Platform, arising before the effective date of the Management Rules, shall be subject to the rules effective at that time. Any such conduct arising after the effective date of the Management Rules, the Rules shall govern.
4.2 JD.HK Open Platform may adjust the Management Rules from time to time according to the platform operation and disclose such adjustment to the merchants through the announcement on JD.HK Open Platform. By settling on JD.HK Open Platform, the merchants acknowledge that they accept the Management Rules that will be adjusted and issued from time to time.
4.3 The merchant shall comply with national laws, administrative regulations, rules of authorities and other normative documents. The Rules shall be applicable to any alleged breach of national laws, administrative regulations, rules of authorities and normative documents, if such breach is stipulated therein. Any matter left unmentioned in the Rules shall be handled by JD.HK Open Platform at its discretion. But JD.HK Open Platform's handling of the merchants does not exempt them from the legal liability they should bear. Any conduct of the merchants on JD.HK Open Platform shall also be subject to the agreements signed with JD.HK Open Platform and its affiliates; Any default shall be deemed as a breach of the Rules.
4.4 The Rules were released on March 22, 2019 and took effect on March 29, 2019.
