Recall Rules for Unqualified or Defective Commodities on JD.HK Open Platform
Chapter I Overview
1.1 The Recall Rules for Unqualified or Defective Commodities on JD.HK Open Platform is formulated to prevent the related commodities from circulating into the market again when they are found to have quality and safety risks or quality and safety problems, aiming to prevent injury and protect the rights and interests of consumers.
1.2 This standard is applicable to all commodities on JD.HK Open Platform.
Chapter II Recall Rules and Handling of Violations
2.1 Categories of recalled commodities
Commodities with quality and safety risks or quality and safety problems identified, announced, or recalled by authoritative quality inspection institutions or manufacturers, commodities eliminated or stopped by the state, expired, invalid and deteriorated commodities, and commodities containing food, condiments, skincare products, etc, the details shall be subject to the requirements of relevant laws and regulations and real-time release by regulatory authorities.
2.2 In the recall process, when it is found that there are quality and safety risks or quality and safety problems in the relevant commodities, the merchants should immediately stop selling and remove the commodities from the shelves. At the same time, the merchants should recall the sold commodities and handle them properly to prevent them from circulating into the market again. The merchants should actively cooperate with the recall, harmless treatment, risk reduction measures, supervision measures for unsold commodities and on-site destruction and other work completed according to the relevant laws and regulations and the requirements of regulatory authorities, and report the recall and handling situation to the customs and other regulatory departments on time.
2.3 Handling of violations
If the merchant violates the relevant rules of Clauses 2.1 and 2.2, JD.HK Open Platform is entitled to deal with the merchant following the general violation of "breach of commitment" in the Credit Management Rules for Merchant of JD.HK Open Platform.
Meanwhile, JD.HK Open Platform will take market control measures based on the severity of the case (including but not limited to screening stores, removing illegal commodities from shelves, limiting the release of commodities, publicizing warnings, closing stores, etc.).
Chapter III Supplementary Provisions
3.1 Any conduct of the merchant of JD.HK Open Platform, which happened before the effective date of the Management Rules, shall be subject to the rules effective at that time. Any such conduct arising after the effective date of the Management Rules, the Rules shall govern.
3.2 JD.HK Open Platform may adjust the management rules from time to time according to the platform operation and disclose such adjustment to the merchants through the announcement on JD.HK Open Platform. By settling on JD.HK Open Platform, the merchants acknowledge that they accept the Management Rules that will be adjusted and issued from time to time.
3.3 The merchant shall comply with national laws, administrative regulations, rules of authorities and other normative documents. The Rules shall be applicable to any alleged breach of national laws, administrative regulations, rules of authorities and normative documents, if such breach is stipulated therein. Any matter left unmentioned in the Rules shall be handled by JD.HK Open Platform at its discretion. But JD.HK Open Platform's handling of the merchants does not exempt them from the legal liability they should bear. Any conduct of the merchants on JD.HK Open Platform shall also be subject to the agreements signed with JD.HK and its affiliates; Any default shall be deemed as a breach of the Rules.
3.4 Any conduct of cross-border e-commerce enterprises on JD.HK Open Platform shall also be subject to the agreements signed with JD.HK and its affiliates; and any breach of contract will be regarded as a violation of the Rules, and corresponding punishment measures will be implemented for those with serious circumstances.
3.5 The Rules were released on March 29, 2019 and took effect on April 5, 2019.
