Rules for Illegal Orders Handling of JD.HK Open Platform

Chapter I    Overview

To protect the rights and interests of consumers and merchants aiming at living consumption, if consumers and merchants violate the rules mentioned in the Rules, consumers promise that they will voluntarily accept the handling of JD.HK Open Platform or merchants according to the Rules. Merchants promise that they will voluntarily accept the treatment of JD.HK Open Platform according to the Rules.

Chapter II   Illegal Order and Handling Rules

2.1 Violations of orders include but are not limited to the following:

2.1.1     One or more people jointly use one or more accounts to place orders on JD.HK Open Platform but do not pay or fully pay, etc. to occupy inventory in violation of regulations;

2.1.2     Merchants use false orders to improve credit or the ordering behavior to help merchants to improve credit with false orders;

2.1.3      The behavior that the suppliers, agents and sellers of commodities or services buy back the commodities and services they supply or sell;

2.1.4     Ordering behavior of purchasing agents, middlemen, retailers or wholesalers, and other personnel or groups, companies, etc. for resale or commercial use (except for enterprise users or signing contracts with special sales channels of JD.HK Open Platform);

2.1.5     Ordering behavior for stealing other's account number, bank account number, and other information, or stealing assets in other's account number;

2.1.6     Behaviors threatening the security of JD.HK Open Platform or merchant system;

2.1.7     Use the software registration account, or the account with any false information in the registration information and order details, or visit or log in to the website of JD.HK in any way not approved by JD.HK Open Platform (such as robot software, spider software, crawler software, screen brushing software, etc.) to carry out acts including but not limited to the following:

(1) Collect and exchange discount coupons;

(2) Participate in the lottery;

(3) Purchase commodities;

(4) Participate in various preferential activities, etc.;

2.1.8     One or more people jointly use one or more accounts on the JD.HK Open Platform to purchase commodities or services that exceed the normal consumption demand (among them, the same buyer, the same payment account, the same delivery address, and the same delivery phone number can be regarded as "one person").

2.1.9     The behavior of refusing to accept the commodities after placing an order includes but is not limited to the following: the order claimed not to be ordered by the receiver, false order, or malicious order judged by JD.HK Open Platform, etc;

2.1.10   Purchase large quantities of commodities and require delivery in batches due to lack of funds or other reasons;

2.1.11   One or more people jointly use one or more accounts to purchase commodities or services on JD.HK Open Platform, and request to change the receiving address and receiver; the total quantity of commodities in a single or cumulative change order is greater than or equal to 50, or the number of changes required within 30 days is greater than or equal to 3, or request to transfer to other carriers for secondary distribution;

2.1.12  Register one or more accounts or one person uses the same or more accounts, through software, technical means, order splitting, or other means, to obtain discounts, gifts, freight, or other benefits; or use the same or more accounts to place orders with others;

2.1.13   Extortion merchant, and the merchant can provide chat records or audio recordings and other evidence;

2.1.14   Release illegal contents, advertisements or spam information by means of order receiving information, order remarks, comments, etc;

2.1.15   Abnormal transaction behavior assessed and identified by relevant national laws and regulations, regulatory authorities, or other rules of JD.HK Open Platform, including but not limited to acts such as non-secondary sales of products imported through cross-border e-commerce.

2.2 In case of any of the situations in 2.1 above, JD.HK Open Platform or merchant is entitled to conduct any or more of the following operations on the illegal orders:

2.2.1     Cancel the order;

2.2.2     No delivery;

2.2.3     Intercept and recover the orders that have been out of warehouse and delivered;

2.2.4     Restrict and reduce the members' rights and interests of JD.HK Open Platform, such as ordering commodities, etc;

2.2.5     For the discount coupons, gifts or physical prizes obtained in the form of 2.1 above, JD.HK Open Platform or merchants have the right to recycle, void, prohibit or restrict their use;

2.2.6     Delete or screening illegal words, pictures or information;

2.2.7     Suspend or stop services;

2.2.8     Other necessary control measures are considered by JD.HK Open Platform and the merchants.

Chapter III       Supplementary Provisions

3.1 In case of any violation of the rules, such as cancellation of the order, failure to deliver the commodities according to the set time, failure to deliver the commodities, etc., it will be handled in accordance with the Rules. If other rules of JD.HK Open Platform are inconsistent with the Rules, the Rules shall apply.

3.2 In case of any violation of orders specified in the Rules, JD.HK Open Platform and merchants will take such measures as canceling orders, not delivering commodities, not providing commodities or services to customers, without any paid or compensation.

3.3 If the order is cancelled due to the illegal order mentioned in the Rules, the refund will be made according to the refund process in the Platform Rules.

3.5 The Rules were released on March 22, 2019 and took effect on March 29, 2019.
