Management Rules for Merchant Violation on JD.HK Open Platform Shopfiy
为了保障消费者购物体验,维护正规店铺的合法经营权益,shopfiy商家发生违规行为时平台有权利参考《京东国际开放平台商家违规积分管理规则》等规则对商家进行违规行为治理。
JD.HK Shopfiy is entitled to resolve any violation of merchant by reference to the Violation Credit Management Rules for Merchants on JD.HK Open Platform and other relevant rules, thus safeguarding the shopping experience of consumers and the legal business rights and interests of compliant stores.
第一条 违规管理:
Chapter I Violation Management
指shopfiy商家出售假冒、盗版商品的行为,包括涉嫌出售假冒商品行为、认定出售假冒商品等行为。为保护消费者权益,对涉及本情形的商家,京东国际有权视情节严重程度采取包括但不限于店铺屏蔽、违规商品下架、限制发布商品、公示警告、关闭店铺等措施,并有权对其关联店铺采取市场管理措施。
Violations refer to Shopify merchants’ sale of counterfeit or pirated commodities, including the suspected and confirmed sale of counterfeit commodities. To protect the consumers’ rights and interests, JD.HK Open Platform shall take measures against the merchants suspected of violations based on the severity of the circumstances, including but not limited to screening stores, removing illegal commodities from shelves, limiting the release of commodities, publicizing warnings, closing stores, etc., and be entitled to take market control measures against the associated stores.

The management measures include but are not limited to:
(一)商家如发生危及交易安全或扰乱京东运营秩序等行为,平台有权依照其行为的危险程度采取市场管控措施。且有权依照协议及平台规则等采取违规处理并要求商家承担违约责任。
(I) If the merchant’s behavior engenders the transaction safety or disturbs the operation order of JD.COM, JD.HK Open Platform shall be entitled to take market control measures as per the severity, or deal with the violation and claim liability for breach against the merchant according to the relevant agreements and rules.
(二)舆情媒体曝光或国家行政部门通报的质量不合格的品牌、品类或批次的商品,或其他要求协查的商品及店铺及京东抽检发现问题的商品和其相关联的商品,平台有权依照其情形严重程度对相关商家的店铺及商品采取商品下架、商品删除等市场管理措施。
(II) For the non-conformed brands, categories or batches of commodities exposed by the public and media or published by the administrative departments, the commodities and stores to be investigated, or the non-conformed commodities and associated commodities found in the random inspection of JD.HK Open Platform, JD.HK Open Platform shall be entitled to take market control measures against said stores and commodities as per the severity, including removing the commodities off the shelves, or deleting the commodities.
(三)因商家行为引发司法诉讼的,若商家存在提供的联系方式无效、消极应对或继续违规等情形,对平台造成或可能造成实际损失或不良影响的,平台有权根据产生或可能产生后果的严重程度采取市场管理措施。
(III) If any judicial action is claimed against the merchant, while the merchant provides invalid contact information, responds to the judicial action negatively, or continues to violate the regulations, which cause or may cause actual losses or adverse effects to JD.HK Open Platform, JD.HK Open Platform shall be entitled to take market control measures as per the severity of such actual or contingent effects.
(四)商家适用《京东国际开放平台商家违规积分管理规则》,当商家涉及相关的违规行为时,平台有权按照规则中的规定采取相应市场管理措施。
(IV) The Violation Credit Management Rules for Merchants on JD.HK Open Platform shall be applied to the merchant. If the merchant violates the relevant rules, JD.HK Open Platform shall be entitled to take corresponding market control measures according to the Rules.
第二条 违规处理:
Chapter II Violation Handling:
(一)商家发生出售假冒商品违规行为的,平台有权依据协议、《京东国际开放平台商家违规积分管理规则》、《京东国际出售假冒商品细则》等对商家进行违规行为治理,且有权在商家管理系统或商家论坛等位置公示。
(I) If the merchant sells counterfeit commodities, JD.HK Open Platform shall be entitled to dispose such violation according to the agreement, the Violation Credit Management Rules for Merchants on JD.HK Open Platform, and the Detailed Rules for the Sale of Counterfeit Commodities on JD.HK Open Platform, and release such violation and disposal results in the merchant management system or merchant BBS.
(二)舆情媒体曝光或国家行政部门通报的质量不合格的品牌、品类或批次的商品,或其他要求协查的商品及店铺及平台抽检发现问题的商品和其相关联的商品,平台有权依照其情形严重程度对相关商家的店铺及商品采取商品下架、商品删除等市场管理措施。

第三条 违规申诉
Chapter III Violation Complaints
针对违规扣分,商家可在被违规处理之时起总计七个工作日内(京东审核时间除外)通过京东商家后台提交违规申诉申请,买手店商家提交申诉资料后将由京东开放平台客服中心及质控部门核实处理。具体规定请参照《违规申诉管理规则》。
The merchant may submit a complaint against the point deduction via the merchant service system of JD.COM within seven working days from the date of violation disposal (except the time for JD.COM review). The relevant complaint materials submitted by the merchant will be verified and handled by the customer service center and quality control department of JD.HK Open Platform. For details, please refer to the Management Rules for Violation Complaints.
第四章 附则
Chapter IV Supplementary Provisions
4.1京东国际开放平台商家的行为,发生在本管理规则生效之日以前的,适用当时的规则。发生在本管理规则生效之日以后的,适用本规则。
4.1 Any conduct of the merchant on JD.HK Open Platform happened before the effective date of the Rules shall be subject to the rules then effective. The Rules shall apply for any such conduct occurring after the effective date of the Rules.
4.2京东国际开放平台可根据平台运营情况随时调整本管理规则并以京东国际开放平台公告的形式向商家公示;商家入驻京东国际开放平台即表示接受京东国际开放平台其后不时调整、颁布的管理规则。
4.2 JD.HK Open Platform may adjust the Rules from time to time considering the operation of the platform and disclose such adjustments to the merchants through the announcement on JD.HK Open Platform. By registering with JD.HK Open Platform, merchants acknowledge to accept the Rules as modified and issued thereafter by JD.HK Open Platform from time to time.
4.3商家应遵守国家法律、行政法规、部门规章等规范性文件。对任何涉嫌违反国家法律、行政法规、部门规章等规范性文件的行为,本规则已有规定的,适用于本规则。本规则尚无规定的,京东国际开放平台有权酌情处理。但京东国际开放平台对商家的处理不免除其应承担的法律责任。商家在京东国际开放平台的任何行为,应同时遵守与京东国际开放平台及其关联公司签订的各项协议;如有违约即视为对本规则的违反。
4.3 The merchant shall comply with the laws, administrative regulations, rules of authorities of the People’s Republic of China and other normative documents. For any alleged breach of the laws, administrative regulations of the People’s Republic of China, rules of authorities or other normative documents, the Rules shall apply if the relevant regulations are stipulated herein. Any matter uncovered in the Rules shall be filed to JD.HK Open Platform for resolution at its discretion. However, actions by JD.HK Open Platform on merchants do not exempt the merchants from the legal liability they should bear. Any conduct of a merchant on JD.HK Open Platform shall also comply with any and all agreements signed with JD.HK and its affiliates. Any default shall be deemed as a breach under the Rules.
4.4本规则于2022年5月18日发布,2022年5月18日生效。
